General Terms and Conditions

These terms and conditions are set out as the basis on which you are allowed to use the web application (the “Web app”), Volume Brussels, or the websites (together with the Web APP, collectively the “Services”) offered by PLAY ASBL (“PLAY”, “we”, “us” or “our”). The following Terms and Conditions are designed to ensure your satisfaction and understanding of the purchase process on Volume Brussels. If you have any questions about the information below, please contact us. These Purchase Terms and Conditions are subject to, and incorporated by this reference, the Terms of Service. Each purchase is a licence to attend particular events, and is subject to the additional terms set forth on that licence.

We may change these Terms of Service from time to time so please check our Web App from time to time for any updates to them to ensure that you are happy with any changes. Your continued use of any part of the Services following any update to these Terms of Service will constitute your acceptance of those changes.

About us : PLAY ASBL - 866.525.546. Rue Nestor de Tière 35, 1030 Brussels, Belgium. volume.brusses@gmail.com

Overview : Your access to and use of the Services is subject to your acceptance and compliance with these Terms of Service. You cannot access or use the Services without accepting these Terms of Service and Privacy Policy (which is incorporated into these Terms of Service by this reference).

General service description : The Services gives you access to the Events Partners’ venues and establishments.

Your account : The Services allow you to register an account which is specific to you. To provide you with access to the Services, we must collect, process and store certain data including, at times, your personal data, which we will do in accordance with these Terms of Service and our Privacy Policy. We can’t guarantee that the Services will be compatible with any or all of your mobile devices or any software which you may use on your device; available all the time or at any specific time; or completely accurate and up to date, although we try.

Who You Are Buying From : These Terms of Service deal with licences purchased via the Services. In the event of a licence purchased through an authorised distribution channel (such as visit.brussels for example), the present Terms of service will be applicable.

Order Confirmation: If you do not receive a confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, it is your responsibility to confirm with Volume Brussels Customer Service, or any other authorised distribution channel whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. Play ASBL will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

Convenience Charges and Order Processing Fees: Licences purchased on Volume Brussels or any other authorised distribution channel are typically subject to a convenience charge and a non-refundable per order processing fee. In many cases, delivery prices will also be owed.

Amount of Licences Per Customer or "Ticket Limits": When purchasing licences on Volume Brussels or any other authorised distribution channel, you are limited to a specified number of licences for each event (also known as a "ticket limit"). This limit is posted during the purchase process and is verified with every transaction. This policy is in effect to discourage unfair ticket buying practices.

Pricing and Availability: Licences for popular events may sell out quickly. Occasionally, additional licences may be available prior to the event. However, the Service does not control this inventory or its availability. In some cases, The service or other distribution channels may receive additional, subsequent allocations of licences for distribution, which may arguably be of similar or higher desirability than those sold on the Services, or may be offered for sale at lower prices than prices charged on the Services.

Availability and Free pass : In the event of a ticket obtained on the Services for free or through an offered voucher, the availability of the licence is at the sole discretion of the Event Partner. Thus, the Event Partner can, at any moment (meaning, even after the beginning of the event), restrict its entries. In that case, PLAY, acting as an executing agent, will have no other choice than to cancel the licence previously chosen for the specific event subject to availability restrictions. PLAY will only be able to provide the ability for the user to choose another event or another date, according to availability. PLAY will not be held responsible for any licence availability limitations.

Cancelled and Postponed Events: Occasionally, events are cancelled or postponed by the Event Partner. Should this occur, we will attempt to contact you to inform you of refund or exchange procedures for that event. For exact instructions on any cancelled or postponed event, please check the event information online or contact us. If you purchase a ticket through the Service and a refund is issued by the Event Partner, then the Service will most likely give you a refund by adding a credit to your balance in the app. PLAY typically only offers refunds and/or exchanges based on the Event Partner’s instructions.

PLAY is not obligated to issue a refund except to the extent that the Event Partner responsible for bringing you the event (1) instructs us to issue a refund, and (2) provides us with the licence funds necessary to issue refunds. In order to receive a refund or an exchange that may be offered, you will have to comply with the Event Partner’s instructions or deadlines, which, along with the decision about whether or not to issue a refund or an exchange, may be at the Event Partner’s discretion.

If PLAY issues you a refund for a ticket, it will issue a refund of the licence’s face value paid (or, if a discounted ticket, then instead the discounted licence price paid) excluding the facility fee and the convenience charge. In no event will delivery prices or any other fees or amounts be refunded. If a refund is issued, it will be issued using the same method of payment that was used to purchase the licences. If a credit card was used to make the refunded purchase, then only that actual credit card will receive the credit for the refund.

PLAY will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled or postponed event. If an event is cancelled, please contact us for information on receiving a refund. If the event was moved or rescheduled, the venue or promoter may set refund limitations. Contact us for exact instructions. Please make sure to include/provide your account number so we can expedite your refund if applicable.

These provisions in relation to the refund policy will only apply in the event of an actual purchase.

Cancelled, Postponed, Unavailable Events and Free pass :  In the event of a licence obtained on the Service for free or through an offered voucher, provisions in relation to refund policy will not apply due to the absence of an actual purchase of a licence. In case of licences obtained graciously (for free or for a small fee) and not purchased, no refund can be given. Moreover, PLAY will not be liable for travel or any other expenses that you or anyone else incurs in connection with a cancelled, postponed or unavailable (due to ticket availability limitations by the Event Partner) event.

Refunds and Exchanges: Before purchasing licences, carefully review your event and seat choices. Policies set forth by the Event Partners, generally prohibit PLAY from issuing exchanges or refunds after a licence has been purchased or for lost, stolen, damaged or destroyed licences, except in the following circumstances :

  • If an event is cancelled by the Event Partner, they are responsible for refunding the original ticket proceeds to you. PLAY will arrange for the full refund to licence holders on the Event Partner’s behalf and subject to us obtaining the funds to be provided from or on behalf of the Event Partner.
  • If an event is postponed by the Event Partner, licence holders will be given the option to either exchange their existing licence for a new licence for the rescheduled event date or receive a full refund.

We will not reimburse the cost of purchased licences after an event has taken place unless instructed otherwise by, and at the discretion of, the Event Partner. You will not be entitled to a refund if you fail to attend an event or make an error when purchasing licences (for example you buy the wrong quantity or the wrong timezoned ticket for a streamed event).

Furthermore, no type of refund or compensation can be asked in the event of a licence obtained on the Service for free or through an offered voucher .

Validity of the licences : Unless mentioned otherwise in the Services, the licence will give access to the events during one night from 6pm to 6am the day after.

Duration of Free pass via visit.brussels : Licences obtained on the Services offered by visits.brussels will be valid up until the 25th of June 2022. PLAY will not be held responsible for matters regarding free licences offered by visit.brussels.

Pricing and Other Errors If the amount you pay for a licence is incorrect regardless of whether because of an error in a price posted on this website (or the one of an authorised distribution channel) or otherwise communicated to you, or you are able to order a licence before its scheduled on-sale or presale date or you are able to order a licence that was not supposed to have been released for sale, then PLAY will have the right to cancel that licence (or the order for that licence) and refund to you the amount that you paid. This will apply regardless of whether because of human error or a transactional malfunction of this website or other Volume Brussels operated system.

Limitation of Liability: You assume all risks incidental to the event for which a ticket is issued, whether before, during or after performance, and you waive any claims for personal injury or death against Play ASBL on behalf of yourself and any accompanying minor.

PLAY assumes no responsibility for licences purchased through third parties or unofficial sales points.

PLAY is not responsible for :

  • Loss or theft of personal mobile devices, any licence stored within the Web App or the Services on a lost or stolen device or any hardcopy licences . Events in real life are generally provided with a door list with names of individuals who have purchased a licence through the Web App or the Services. Our Event Partners may seek to allow you to gain entry to the event without your mobile phone by asking for ID verification in order to allow access to the event. However, this is not guaranteed.
  • Any personal arrangements including travel, accommodation or hospitality relating to the attendance or an event. Neither we nor the relevant event Partner shall be liable to you for any loss of enjoyment or wasted expenditure.
  • Any exchange or bank fees incurred by you arising from the normal course of payment or reimbursement.

PLAY shall have no liability if you are refused entry to, or removed from, an event by any third party and for any reason.

Licence, Ejection and Cancellation, No Redemption Value: Event Partners reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, who uses vulgar or abusive language or who fails to comply with Event Partner rules, regardless of how the ticket was obtained (purchased or obtained graciously). The event entrance remains at the Event Partner’s sole discretion and PLAY can not be held responsible for any admission refusal or ejection of an event. Breach of terms or rules will terminate your licence to attend the event without refund. A licence is revocable and admission may be refused without refunding the ticket's face amount. A ticket is not redeemable for cash.

By way of example, the Event Partner may revoke a licence holder who :

  • Has behaved in a manner which, in the reasonable opinion of the Event Partner has, or is likely to, affect the enjoyment of other visitors; or
  • Uses threatening, abusive or insulting words or behaviour, or in any way provokes or behaves in a manner which may provoke a breach of the peace; o
  • In the reasonable opinion of the Event Partner , is under the influence of alcohol or drugs; or
  • Fails, when required, to produce proof of identity or age (as or when appropriate).

You Are Subject to Search: You and your belongings may be searched on entry to the event. You consent to such searches and waive any related claims that may arise. If you elect not to consent to such searches, you may be denied entry to the event without refund or other compensation. Under certain facility rules, certain items may not be brought into the premises, including without limitation, alcohol, drugs, controlled substances, cameras, recording devices, bundles and containers.

Recording, Transmission and Exhibition: You agree not to record or transmit, or aid in recording or transmitting, any description, account, picture, or reproduction of the event. You agree that the event for which you purchase licences is a public event, that your appearance and actions inside and outside the venue where the event occurs are public in nature, and that you have no expectation of privacy with regard to your actions or conduct at the event. You grant permission to PLAY and the Event Partner(s) to utilise your name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, you or anyone acting on your behalf.

When registering an account, you will be required to provide your name, mobile number and email address. In order to use certain aspects and features of the Services, you must have a compatible mobile device, access to the Internet, mobile messaging and data services. Fees and charges may apply to your use of the Internet or mobile messaging services. You agree that you are responsible for any such fees or charges where these apply.

Unlawful Re-Sale of licences; Commercial Purposes: Unlawful resale of licences (or attempted resale) is grounds for seizure and cancellation without compensation. A licence shall not be used for advertising, promotions, contests or sweepstakes, unless formal written authorization is given by the Event Partner, provided that even if such consent is obtained, any use of PLAY 's trademarks and other intellectual property is subject to PLAY's consent.

We reserve the right to cancel any transaction or remove, suspend, edit or modify your access to the Services at our discretion if we have reason to believe you have used the Services in contravention of these Terms of service. Any and all licence(s) purchased as part of such a transaction will be void.
